
Real Estate Sale at the Notary: TNB Portal and Weekend Transactions
With Article 61/A of Notary Law No. 1512, notaries have been authorized to make sales contracts that are the basis for land registration. Transactions are possible, including Saturdays and Sundays — but there are some rules.
With the 2022 regulation, notaries gained the authority to make a real estate sales agreement, which is the basis for title registration. This created an alternative channel for the transfer process, which could previously only be done by going to the land registry. Thanks to the weekend on-duty notary application, sales can also be made on Saturdays and Sundays.
Application: TNB Portal
Sales appointment applications at the notary are made at portal.tnb.org.tr. The application stages are entirely digital, and the notary personnel check the title deeds through TAKPAS and whether there is a lien/mortgage/restrictive annotation on the real estate.
Critical Rule: Shared Sale Limit
If there is shared ownership on the real estate, the seller must sell all of their share. Partial share sales are systemically limited in notary applications. If you want to divide the share, you need to use the land registry channel.
DASK and Missing Document Control
The system automatically scans whether there is a valid DASK policy for real estates with residential qualifications. If there is no policy, a warning message is displayed to the applicant stating that the DASK policy must be submitted.
If there are deficiencies in the records requested through TAKPAS, the land registry is legally obliged to upload these deficiencies to the system within 3 business days at the latest.
Payment and Appointment
After the examination is completed, an e-collection serial number is sent via SMS for the payment of fees and revolving capital. The parties are present at the notary at the appointment time only for wet signature and original ID.
Important Warning: 10-Day Cancellation
If the parties who are not present at the notary at the appointment time do not renew their applications within 10 days, the notary application is automatically canceled by the system. Re-application requires a repetition of the entire process from scratch.

Important note: The registration of the notary sale transaction in the land registry is also required. The notary sends the contract to the land registry for registration after signing the contract. Ownership is valid when registered in the land registry.
